Health and Safety:

The Health and Safety at Work Act 1974 places a duty of care on any and all employers to ‘ensure so far as is reasonably practicable the health, safety and welfare at work of all their employees’.

This means that whatever your business, and regardless of size, if you have anyone in your employ it is your responsibility to make sure that they are not put at risk by either your actions or inactions.

In order to comply with the act, you must:

  • Have in place a health & safety management system
  • Have a safety policy statement (if at least 5 people are employed)
  • Have an adequate number of people who are competent to deal with health and safety issues
  • Have completed a risk assessment, or had such an assessment done by an outside contractor
  • Train and inform your staff regarding health and safety issues
  • Ensure that all hazardous materials are stored, labelled and handled appropriately
  • Ensure that work equipment is maintained to a proper standard
  • Ensure that adequate precautions are made against the possibility of fire or explosions

Employees also have certain duties of care under the Health and Safety at Work Act. While you are entitled to be able to work in a safe environment in which your health and safety are safeguarded and properly controlled, you are still obliged to take appropriate care of yourself and those around you.

You must also co-operate with your employer and with co-workers in order to maintain a safe and healthy environment.

If you feel that your employer has failed to comply with aspects of the Health and Safety at Work Act your first action should be to communicate your worries to your employer, supervisor or your health & safety representative.

If, after talking to one or more of these people, you still have concerns, you might need to contact your local enforcing authority and/or the Employment Medical Advisory Service.
